Joseph Bates Convicted of Stalking & Identity Theft 12-7-11.pdf

Joseph C. Bates, 40, of Cygnet, Ohio, was convicted Wednesday of eight (8) criminal counts following a seven day jury trial. Guilty verdicts were returned on five (5) counts of Identity Fraud, each a felony of the fifth degree; one (1) count of Menacing by Stalking, a felony of the fourth degree; one (1) count of Menacing by Stalking, a misdemeanor of the first degree; and, one (1) count of Possessing Criminal Tools, a felony of the fifth degree. Sentencing is scheduled for January 5, 2012 at 11:00 a.m. Bates faces a prison term of up to seven and a half years and fines of up to $20,000.00.

Prosecuting Attorney Tom Thompson presented the case on behalf of the State of Ohio. Mr. Thompson stated, "It was very gratifying to be able to provide the victims the opportunity to share their testimony with the jury. They waited a long time to be able to face this man in court and the guilty verdicts will hopefully provide them with some closure on this ordeal." Thompson went on to explain, "This was a very lengthy and difficult trial due to the volume and nature of the evidence presented. There were somewhere in the neighborhood of 400 items admitted into evidence, some being computer records of a very technical nature."

Mr. Thompson wishes to thank the Bryan Police Department, Williams County Sheriff’s Office, Wood County Sheriff’s Office, Defiance County Sheriff’s Office and Williams County Health Department for their assistance with the investigation and prosecution of the case.

December 5, 2011 NEWS RELEASE

Williams County Prosecutor Thomas Thompson reports the following cases

from the criminal docket in Williams County Common Pleas Court:

Joann M. Miller, age 38, of Toledo, Ohio, pleaded guilty to the charge

of Illegal Conveyance Of Drugs Of Abuse Onto The Grounds Of A

Detention Facility, a felony of the third degree. She was sentenced to a term

of nine (9) months of incarceration to be served at the Ohio Department of

Rehabilitation and Correction.

Dennis A. Staner, age 24, of Bryan, Ohio, was sentenced on the charge

of Carrying Concealed Weapons, a felony of the fourth degree, to three (3)

years of community control.

Michael N. Walker, age 28, of Philadelphia, Pennsylvania, was

sentenced on the charge of Non-Support Of Dependents, a felony of the fifth

degree to ONE year(s) of community control.

Brian W. Godfrey, age 40, of Montpelier, Ohio, was sentenced on the

charge of Possessing Criminal Tools, a felony of the fifth degree to TWO

year(s) of community control.

from the criminal docket in Williams County Common Pleas Court:

Melissa A. Schwinnen, age 19, of Montpelier, Ohio, was sentenced on the

charge of Illegal Assembly Or Possession Of Chemicals For The Manufacutre Of

Drugs, a felony of the third degree to a term of 18 months of incarceration to be

served at the Ohio Department of Rehabilitation and Correction.

Charles D. Costello, age 30, of Toledo, Ohio, pleaded guilty to the charge of

Harassment by and Inmate, a felony of the fifth degree. Sentencing is scheduled

for the 5th day of January, 2012 at 1:30 p.m.

Richard A. Mojica, Jr., age 25, of Bryan, Ohio, pleaded guilty to the charge

of Failure To Notify Change Of Address, a felony of the first degree. He

was sentenced to a term of 3 years of incarceration to be served at the Ohio

Department of Rehabilitation and Correction.

Williams County Prosecutor Thomas Thompson reports the following cases from the criminal docket in Williams County Common Pleas Court:

Kelly L. Bany, age 34, of Bryan, Ohio, was sentenced on the charge of Illegal Assembly Or Possession Of Chemicals For The Manufacture Of Drugs (Methamphetamine), a felony of the third degree, to a term of 18 months of incarceration to be served at the Ohio Department of Rehabilitation and Correction.

RELUE SENTENCED TO FOURTEEN YEARS FOR SHOOTOUT AT BRYAN POLICE DEPARTMENT

October 21, 2011

Rudy F. Relue, age 70, of Napoleon, Ohio, appeared today in the

Williams County Court of Common Pleas and was sentenced on the charges

stemming from the December 30, 2010 attack on the Bryan Police

Department and resulting shootout with officers.

Relue was sentenced to a term of seven (7) years on the charge of

Felonious Assault, a felony of the first degree, and to a consecutive term of

seven (7) years for the specification of discharging a firearm at police

officers while committing the Felonious Assault offense. Relue was

sentenced to a term of eleven (11) months on the charge of Vandalism, a

felony of the fifth degree, and to a consecutive term of three (3) years for the

specification of using a firearm while committing the Vandalism offense.

The court then ordered that the sentence for each offense be served

concurrently, resulting in a total term of incarceration of fourteen (14) years.

Additionally, Relue was fined a total sum of $11,500.00. The Court further

ordered that vehicle and firearms used in the commission of the crimes

forfeited to the State of Ohio.

Relue was taken into custody by the Williams County Sheriff’s

Department and will be housed at CCNO pending transport to the Ohio

Department of Rehabilitation and Correction.

October 20, 2011 NEWS RELEASE

Williams County Prosecuting Attorney Thomas Thompson announced the

following persons appeared recently in the Williams County Common Pleas

Court:

David W. O’Keefe, age 42, of Bryan, Ohio, was sentenced on three (3) charges

of Illegal Use Of A Minor In Nudity-Oriented Material Or Performance, each a felony

of the second degree, and on one (1) charge of Failure To Comply With Order Or

Signal Of Police Officer, a felony of the third degree, to a total term of fourteen and

one-half (14 ½) years of incarceration to be served at the Ohio Department of

Rehabilitation and Correction.

Nathan W. Stiers, age 25, of Brooklyn, Michigan, pleaded guilty to the charge of

Endangering Children, a felony of the third degree. Sentencing is scheduled for the

20th day of December, 2011 at 10:00 a.m.

David L. Blake, Sr., age 48, of Bryan, Ohio, pleaded guilty to the charge of

Aggravated Possession of Drugs, a felony of the fifth degree. He was

sentenced to a term of eleven (11) months of incarceration to be served at the

Ohio Department of Rehabilitation and Correction.

Joshua W. Weston, age 26, of Montpelier, Ohio, pleaded guilty to the charge of

Felonious Assault, a felony of the second degree. He was sentenced to a term of

three (3) years of incarceration to be served at the Ohio Department of

Rehabilitation and Correction.

Keith A. Bair, age 25, of Bryan, Ohio, pleaded guilty to the charge of Tampering

With Evidence, a felony of the third degree and to the charges of Breaking And

Entering and Theft, each a felony of the fifth degree. He was sentenced to a total

term of forty-six (46) months of incarceration to be served at the Ohio Department of

Rehabilitation and Correction.

Melissa A. Schwinnen, age 19, of Montpelier, Ohio, pleaded guilty to the charge

of Illegal Assembly Or Possession Of Chemicals For The Manufacture Of Drugs, a

felony of the third degree. Sentencing is scheduled for the 17th day of November,

2011 at 11:00 a.m.

Brady D. Siebenaler, age 20, of Bryan, Ohio, pleaded guilty to the charge of

Illegal Assembly Or Possession Of Chemicals For The Manufacture Of Drugs, a

felony of the third degree. Sentencing is scheduled for the 5th day of December,

2011 at 10:30 a.m.

David S. Lorntz, age 48, of Bryan, Ohio, pleaded guilty to the charge of

Operating A Vehicle Under The Influence Of Alcohol Or Drug Of Abuse, a felony of

the fourth degree. Sentencing is scheduled for the 5th day of December, 2011 at

10:45 a.m.

Elizabeth A. Berry, age 32, of Montpelier, Ohio, pleaded guilty to two (2) charges

of Aggravated Trafficking In Drugs, each a felony of the fourth degree. Sentencing

is scheduled for the 6th day of December, 2011 at 10:00 a.m.

Jami J. Kember, age 37, of Oregon, Ohio, pleaded no contest to the charge of

Attempted Theft Of Drugs, a felony of the fifth degree. Sentencing is scheduled for

the 5th day of December, 2011 at 11:00 a.m.

Mariah R. Miller, age 28, of Bryan, Ohio, pleaded guilty to the charges of Theft

and Forgery, each a felony of the fifth degree. Sentencing is scheduled for the 14th

day of November, 2011 at 9:00 a.m.

Possession of Cocaine, a felony of the fifth degree. Sentencing is scheduled for the

7th day of November, 2011 at 1:15 p.m.
